In consideration of being permitted to participate in the activities organized by La Leona Waterfall Liability Limited Company (hereinafter referred to as "the Company") in Costa Rica, I, the undersigned participant, hereby acknowledge and agree to the following terms and conditions:
En consideración de ser permitido(a) a participar en las actividades organizadas por la Compañía LA LEONA WATERFALL S.R.L (en adelante referida como "la Compañía") en Costa Rica, yo, el/la abajo firmante participante, por la presente reconozco y acepto los siguientes términos y condiciones:
1.Assumption of Risk: I am aware that participating in outdoor activities and tours organized by the Company involves certain inherent risks, including but not limited to physical exertion, exposure to natural elements, wildlife encounters, uneven terrain, and transportation-related risks. We acknowledge that these risks may result in personal injury, illness, property damage, or even death.

Asunción de Riesgos: Soy consciente de que participar en actividades al aire libre y tours organizados por la Compañía implica ciertos riesgos inherentes, incluyendo, pero no limitándose a, esfuerzo físico, exposición a elementos naturales, encuentros con la vida silvestre, terreno irregular y riesgos relacionados con el transporte. Reconocemos que estos riesgos pueden resultar en lesiones personales, enfermedad, daño a la propiedad o incluso la muerte.
2.Accident Reporting: In the event of an accident or injury during the tour, I agree to immediately report the incident to the Company's authorized staff or representatives. I understand that prompt reporting is crucial for proper response and assistance. I am aware that the lack of immediate reporting may affect the Company's ability to accurately assess the situation and determine if the accident occurred during our tour, potentially impacting any claims related to the incident.
2. Reporte de Accidentes: En caso de un accidente o lesión durante el tour, acepto reportar inmediatamente el incidente al personal autorizado o representantes de la Compañía. Entiendo que el reporte oportuno es crucial para una respuesta y asistencia adecuadas. Soy consciente de que la falta de reporte inmediato puede afectar la capacidad de la Compañía para evaluar con precisión la situación y determinar si el accidente ocurrió durante nuestro tour, lo que podría afectar cualquier reclamación relacionada con el incidente.
3.No Claims After Leaving Facilities: I understand and acknowledge that I will not have the right to make any claims from the Company once I leave its facilities, regardless of whether the claims arise from incidents during the tour.
3. No Reclamos Después de Abandonar las Instalaciones: Entiendo y reconozco que no tendré derecho a presentar reclamaciones contra la Compañía una vez que abandone sus instalaciones, independientemente de si las reclamaciones surgen de incidentes durante el tour.
4. Watercolor Disclaimer: I understand that the natural color of the water at La Leona Waterfall may vary due to factors such as weather conditions, sediment levels, and other natural influences. The turquoise blue color of the water, often associated with the waterfall, is a natural effect and might not be consistently present.
4. Color del Agua: Comprendo que el color natural del agua puede variar debido a factores como las condiciones climáticas, los niveles de sedimento y otras influencias naturales. El color azul turquesa del agua, a menudo asociado con la cascada, es un efecto natural y puede que no esté presente de manera consistente.
5. Fitness to Participate: I affirm that I am physically and mentally fit to participate in the activities organized by the Company, as described in the tour description I confirm I don’t have knee issues, ankle issues, or mobility issues that prevent me from completing the activities. I understand that it is my responsibility to assess my health and abilities before engaging in any activities and to disclose any relevant medical conditions to the Company.
5. Capacidad para Participar: Afirmo que estoy física y mentalmente en condiciones de participar en las actividades organizadas por la Compañía, según se describe en la descripción del tour. Confirmo que no tengo problemas de rodilla, problemas de tobillo ni problemas de movilidad que me impidan completar las actividades. Entiendo que es mi responsabilidad evaluar mi salud y habilidades antes de participar en cualquier actividad y divulgar cualquier condición médica relevante a la Compañía.
6. Compliance with Instructions: I agree to follow all instructions, rules, and regulations provided by the Company and its representatives. I understand that failure to comply with these instructions may result in our removal from the activity without a refund or release of responsibility.
6. Instrucciones: Acepto seguir todas las instrucciones, reglas y regulaciones proporcionadas por la Compañía y sus representantes. Entiendo que la falta de cumplimiento de estas instrucciones puede resultar en nuestra expulsión de la actividad sin reembolso o liberación de responsabilidad.
7 Release of Liability: I hereby release, discharge, and hold harmless the Company, its officers, employees, guides, agents, and contractors from any and all claims, actions, suits, costs, expenses, damages, or liabilities, whether known or unknown, arising out of or related to our participation in the activities organized by the Company. This release includes claims based on the Company's alleged negligence, gross negligence, or other fault.
7. Liberación de Responsabilidad: Por la presente, libero, eximo y libero de responsabilidad a la Compañía, sus directivos, empleados, guías, agentes y contratistas de cualquier reclamación, acción, demanda, costos, gastos, daños o responsabilidades, ya sean conocidos o desconocidos, derivados de o relacionados con nuestra participación en las actividades organizadas por la Compañía. Esta liberación incluye reclamaciones basadas en la supuesta negligencia, negligencia grave u otra falta de la Compañía.
8. Severability: If any provision of this waiver is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
8. Separabilidad: Si alguna disposición de este descargo de responsabilidad se considera inválida o inaplicable, las disposiciones restantes permanecerán en pleno vigor y efecto.
9. Material Damage: In the event of accidental, negligent, or malicious damage to my property including, but not limited to mobile phones, cameras, clothing, accessories, and other personal equipment, we accept all personal liability, and will not hold the company responsible for any such damage.
9. Daño Material: En caso de daño accidental, negligente o malicioso a mi propiedad, incluyendo, pero no limitándose a teléfonos móviles, cámaras, ropa, accesorios y otros equipos personales, aceptamos toda la responsabilidad personal y no responsabilizaremos a la compañía por dicho daño.
10. Refunds: Once the activity is underway, refunds will only be granted in the event of cancellation due to adverse weather conditions. We retain the right to cancel the activity when weather conditions present potential risks.
10. Reembolsos: Una vez que la actividad esté en marcha, los reembolsos solo se otorgarán en caso de cancelación debido a condiciones climáticas adversas. Nos reservamos el derecho de cancelar la actividad cuando las condiciones climáticas presenten riesgos potenciales.
By signing below, we acknowledge that we have carefully read and understood this waiver of liability and voluntarily agree to its terms and conditions.
Al firmar a continuación, reconocemos que hemos leído y entendido cuidadosamente este descargo de responsabilidad y aceptamos voluntariamente sus términos y condiciones.
